Florida District Court Judge Aileen Cannon issued an opinion today dismissing Special Counsel Jack Smith’s case against U.S. President Donald Trump over Trump’s handling of classified documents. Smith’s case is dismissed on the grounds that it violated the Appointments Clause of the U.S. Constitution. U.S. Congressman Morgan Griffith (R-VA) issued the following statement:

“Today’s opinion issued by Judge Cannon is an appropriate decision. It stands as proof that the administrative branch cannot do whatever they want to do just because they feel like it. There is a process, and that process requires Congressional approval, specifically U.S. Senate confirmation.

“While other Special Counsel have been appointed in the past, in those cases there were either distinguishing facts, or the appointment was unchallenged. In this case, President Trump’s attorneys challenged the appointment, as was their right to do.

“While Special Counsel Smith can still appeal Judge Cannon’s ruling, I hope he does not pursue this case any further.”
