Griffith Statement on EPA Defeat in Court Case
Tuesday,
Aug 21, 2012 -
Congressman Morgan Griffith (R-VA) released the following statement today after the U.S. Court of Appeals for the District of Columbia Circuit struck down an Environmental Protection Agency (EPA) regulation to control air pollution in the eastern United States:
“Thankfully we’re seeing a growing pattern in the courts. Today, a federal court found yet another example of the EPA exceeding its statutory authority. According to the U.S. Court of Appeals for the District of Columbia Circuit, the EPA’s regulation of interstate air pollution, known as the Cross-State Air Pollution Rule, is unlawful and cannot be enforced. The court ruled that the EPA exceeded its authority in two different ways under the Clean Air Act, and must rewrite the rule. Twenty-seven eastern states could have been negatively impacted by this burdensome rule, and I’m glad to see it go. Congratulations to the more than three dozen challengers who brought the suit against the EPA.”
